Bill C-45
Organizations have always been subject to criminal prosecution with respect to criminal negligence and the performance of prohibited acts, but proving a breach of legal duty in the past has been difficult. Growing public outcry and mounting pressure following several recent industrial accidents have resulted in the introduction of Bill C-45, which is an act to amend the Criminal Code of Canada.
Bill C-45 re-defines and expands organizational accountability within the Criminal Code and introduces a new Occupational Health and Safety (OHS) duty that may hold organizations and their representatives criminally liable for any workplace related injury or death.

Health, Safety, and the Law
In Canada, employers and supervisors have health and safety obligations to the employees who work under their direction and for the work area over which they have authority. While these obligations may vary slightly from province to province, they share a common general duty clause: "to take every reasonable precaution to protect the safety of a worker".In addition, employers must ensure that they hire competent supervisors who are knowledgeable about workplace processes, hazards existing in the workplace, and applicable Occupational Health and Safety laws.
Although many supervisors may be familiar with processes in their workplace and the hazards associated with these processes, they might not be considered “competent” in terms of their knowledge and obligations under health and safety laws and Bill C-45.

Bloodborne Pathogens
The potential for transmission of illness or disease, such as HIV, Hepatitis B, or other bloodborne pathogens, is an ongoing concern to employers and employees in any workplace, as well as to emergency response personnel. Any situation in which blood is present in the work environment provides a risk of infection from bloodborne pathogens through contact with the skin or mucous membranes or by penetration of the skin.
Therefore, it is important for employees to know and to understand fully the potential dangers that bloodborne pathogens can pose in the workplace, as well as to be aware of the standard precautions that they should regularly follow in order to prevent exposure to these pathogens.
